§ 19.27.050. Commercial use.

  • (a)

    The establishment or operation of any business which is engaged in any commercial marijuana activity, or which provides a space for the use of marijuana or marijuana products in any place other than a private residence, is a prohibited use in all zoning districts of the city. No use permit, variance, building permit, or any other entitlement or permit, whether administrative or discretionary, shall be approved or issued for the establishment or operation of any such business. Businesses subject to this section include, but are not limited to, businesses licensed by any government entity under Division 10 of the California Business and Professions Code, as that division is proposed to the voters for the November 2016 election and, if approved, as that division may be amended from time to time.

    (b)

    To the extent such a prohibition is permitted under California law, delivery of marijuana or marijuana products within the city is prohibited, regardless of any license or other authorization a person may have to engage in any commercial marijuana activity outside of the city.
